Rental Agreement for Mobile Paint Splatter Room

This Rental Agreement ("Agreement") is made and entered into by and between Jardine Entertainment LLC, d.b.a. Ragescape, referred to herein as the "Company," and the undersigned renter ("Client"), collectively referred to as the "Parties." By signing this Agreement, the Client agrees to the following terms and conditions:

1. Rental Details
Rental Items: Mobile Paint Splatter Room, including inflatable structure, paint brushes, paint blasters, LED lights, room blower, speaker, and one 5-gallon bucket of paint.
Rental Period: As agreed upon at the time of booking.
Additional Items/Add-Ons: Extra paint buckets, disposable protective gear, canvases, and delivery, setup, and cleanup services, if selected by the Client.

2. Payment and Fees
To reserve the rental, the Client may pay either a deposit or the full amount at the time of booking.
Any remaining balance is due at the time of the appointment, before the room is set up, or before pickup for self-pickup rentals.
Afterpay installment payments are available at checkout.
Unpaid reservations are released 1 hour after booking.
A security deposit may be required at the discretion of the Company.

3. Delivery, Setup, and Cleanup
Delivery, setup, and cleanup is an optional add-on. If it is selected, the Company will deliver, set up, and clean up the rented items for an additional fee.
Delivery includes the first 50 miles one-way from the Company's location. Beyond 50 miles one-way, mileage is charged at $0.75 per mile each way, to the event location and back.
Trips over 150 miles one-way add a $250 overnight fee.
Trips over 250 miles one-way are available by custom quote only.
Self-pickup: If the Client does not purchase delivery, the Client is responsible for picking up, transporting, setting up, cleaning, and returning all rented items to the Company at the agreed time in the same condition, excluding normal wear and tear.
The Client must ensure a safe and appropriate space for setup.

4. Client Responsibilities
The Client is responsible for the rented items from the time of delivery or pickup until they are returned to the Company.
The Client agrees to:
Use the rented items as intended and in a safe manner.
Prevent unauthorized use or access to the rented items.
Keep the rented items in good condition and return them in the same condition as received, excluding normal wear and tear.

5. Damage, Loss, or Theft
The Client assumes full responsibility for any loss, theft, or damage to the rented items while in their possession.
In the event of damage, loss, or theft, the Client agrees to reimburse the Company for the full repair or replacement cost of the affected items.

6. Assumption of Risk
The Client acknowledges that participation in the paint splatter activities involves certain risks, including but not limited to the risk of paint spills or personal injury.
The Client agrees to assume all risks associated with the use of the rented items and activities.

7. Release of Liability
The Client agrees that Ragescape, Jardine Entertainment LLC, and their affiliates, owners, employees, and contractors ("Released Parties") are not responsible for any injuries, illnesses, or property damages arising from the use of the rented items or participation in activities.
This includes, but is not limited to, damages caused by:
The inflatable room falling or tipping over and damaging property such as houses or fences.
Paint staining floors, clothing, furniture, or other personal property.
Paint entering pools and causing damage to pool equipment or surfaces.
Any other scenario involving the rented items or related activities.
The Client agrees to release, waive, and discharge the Released Parties from all claims, liabilities, costs, or expenses, including medical expenses or property repair costs, arising from the rental or use of the Company's products or services.

8. Indemnification
The Client agrees to indemnify and hold harmless the Released Parties from any claims, damages, or liabilities resulting from the use of the rented items or participation in activities, whether caused by the Client, their guests, or third parties.

9. Cancellation Policy
All sales are final and no refunds are issued.
If the Client cancels at least 48 hours before the scheduled booking start time, the Client may exchange the booking for a voucher equal to the amount paid.
Cancellations made less than 48 hours before the scheduled start time, and no-shows, forfeit the amount paid.

10. Governing Law
This Agreement shall be governed by the laws of the State of California, without regard to its conflict of laws principles.

11. Entire Agreement
This Agreement constitutes the entire agreement between the Parties and supersedes any prior agreements or understandings.
Any modifications to this Agreement must be made in writing and signed by both Parties.

12. Privacy Policy
Ragescape values your privacy and is committed to protecting your personal information. The Client's government-issued ID is scanned to verify the Client's identity and age and to document who accepts responsibility for the rental. No image of the ID is stored. Only the name, date of birth, expiration date, issuing state, and the last four characters of the ID number are kept. Your information will not be shared, sold, or used for any other purpose. We comply with all applicable California privacy laws, including the California Consumer Privacy Act (CCPA). You have the right to request access to or deletion of your personal information at any time by contacting us at info@ragescaperooms.com. By submitting this form, you acknowledge and agree to this policy.

13. Digital Signature
By digitally signing this Agreement, the Client acknowledges that they have read, understood, and agree to all terms and conditions set forth herein, including the release of liability and indemnification provisions.
