1. Who we are

These Creator Partner Terms (the "Terms") govern the Creator Partner Program (the "Program"). The Program is offered by two separate companies:

  • Jardine Entertainment LLC, doing business as Ragescape, for bookings at Ragescape; and
  • Chopscape LLC, doing business as Chopscape Axe Throwing, for bookings at Chopscape.

Each company is responsible only for fees earned on its own bookings. "We", "us" and "our" mean whichever of those companies the booking or matter relates to. "You" means the person who signs up as a creator partner. "Followers" means anyone who opens your link or uses your code.

2. The short version

  • You share your link or code. Followers get $10.00 off.
  • You earn a fee for each attraction a follower books and visits. The fee grows with your results: Opener (from the start, the minimum fee); Rising (5+ visits, 12% of the attraction's net value); Pro (15+ visits, 15% of the attraction's net value); Headliner (40+ visits, 20% of the attraction's net value). Each fee is locked in when the booking is made.
  • Fees become available 7 days after the visit, and you cash out through Stripe.
  • You must clearly disclose that you are paid, every time, and only post honest content about real visits.
  • No coupon sites, no ads on our names, no self-booking, and never show or describe car smashing.
  • We can hold or reverse fees for cancellations, refunds, mistakes or misuse, and every action is logged.

The short version is a summary. The full Terms below are what apply.

3. Joining the program

  1. You must be at least 18, live in the United States, be able to enter a binding contract, and control the social accounts, websites or channels you tell us about.
  2. You must give accurate information and keep it up to date. You may hold one creator account. If you also host a rental with us, that is a separate host account under the Host Partner Terms.
  3. We review applications and may approve or decline any application at our discretion. There is no minimum follower count.
  4. You accept these Terms by ticking the box when you sign up. We record the version you accepted, the date and time, and the IP address used.

4. Your codes and links

  1. Choosing codes. You may create codes in your portal, up to the limit shown there. Codes must not be offensive, misleading, or use someone else's name, brand or trademark. We may decline, change or remove a code that breaks these rules; if we change one that is in use we will tell you.
  2. How attribution works. When someone opens your link, our website saves your code on that browser for 30 days in a first-party cookie, so the $10.00 discount and your credit follow them to our booking and Bundle & Save pages even if they close the page and come back. A follower who switches browsers or devices can type your code into the "Have a code?" box on our booking pages. The most recent partner link or code a person used is the one credited, and only one partner is ever credited for a booking.
  3. How long codes last. Codes do not expire while you are an active partner. If no booking with a code has visited for 180 days, we pause it and email you at least 30 days before. You can switch a paused code back on from your portal. You can pause any code yourself at any time.
  4. Tracked links. Links from your portal may carry a tag showing where they were shared (for example Instagram). The tag is only used for your analytics.

5. What counts as a qualified booking

A booking is a "qualified booking" only when all of the following are true:

  1. It was made online with your code recorded on it by our booking system, as described in section 4;
  2. It has a price greater than zero (bookings paid entirely with a gift certificate, package, comp or other no-charge arrangement do not qualify);
  3. The visit took place, and the booking was not cancelled, refunded, charged back or marked as a no-show;
  4. The guest is not you, a member of your household, or anyone booking on your behalf or at your direction; and
  5. The booking complies with these Terms and was not obtained through misleading, prohibited or fraudulent activity.

Our booking records decide whether a booking carried your code. Bookings by phone, walk-in, through third-party sites, or without your code recorded do not qualify, even if the guest found us through you. Rescheduled bookings keep their credit and move to the new visit date.

6. Fees, tiers and the follower offer

  1. Per attraction. You earn a fee for each attraction in a qualified booking. When a follower books several attractions together through Bundle & Save, each attraction earns its own fee, paid by the company that runs it (the private party room is not an attraction).
  2. Net value. An attraction's "net value" is what the follower paid for it after discounts (including the $10.00 follower discount and any bundle discount), before tax and excluding add-ons, merchandise, gift cards, tips and fees.
  3. Tiers. Your tier is set by the number of qualified bookings with your codes that visited in the previous 90 days, counting each guest once per venue per day. The current tiers are: Opener (from the start, the minimum fee); Rising (5+ visits, 12% of the attraction's net value); Pro (15+ visits, 15% of the attraction's net value); Headliner (40+ visits, 20% of the attraction's net value). Your portal always shows the current tiers and where you stand.
  4. The fee. Each attraction earns the greater of your tier's percentage of its net value and the minimum fee. The minimum is $10.00 when the attraction's net value is $30.00 or more, and $5.00 otherwise. No attraction earns more than $75.00 or more than its own net value.
  5. Locked in. The fee for a booking is worked out and locked when the booking is recorded. A later change in your tier does not change it, up or down.
  6. Launch bonus. A one-time bonus of $25.00 is added to your balance when 3 qualified bookings have visited within 45 days of your account being created. It is subject to the same holds and reversals as other fees.
  7. The follower offer. Followers who book with your code currently receive $10.00 off. Only one discount code can be applied to a booking, except that the bundle discount still applies.
  8. No other compensation. These fees are the only compensation you receive under the Program. There is no fee for posting, no guaranteed minimum, and no share of our revenue. Any separate paid arrangement must be agreed in writing.
  9. Currency. All amounts are in US dollars.

7. Payouts, taxes and cash-out

  1. Timing. A fee shows as "Upcoming" until the visit date, then "Pending" for 7 days so late cancellations and refunds can be processed, then "Available". Before a fee becomes available we check again that the booking was not cancelled.
  2. Stripe. Payouts are made through Stripe Connect. You must create or connect a Stripe account and give Stripe the identity, bank and tax information it requests. Stripe's own terms, including the Stripe Connected Account Agreement (opens in a new tab), apply. We never see or store your full bank account number.
  3. Two payers. Ragescape fees are paid by Jardine Entertainment LLC and Chopscape fees by Chopscape LLC. Your portal shows a separate balance and cash-out for each.
  4. Cash-out. You may cash out a venue's available balance once it is at least $25.00. Large or unusual cash-outs may be held for a manual check.
  5. Taxes. You are responsible for all taxes on your fees. Stripe collects the tax information we need (such as a Form W-9), and each company issues any required IRS forms (such as Form 1099-NEC), delivered through Stripe, when your payments from it reach the reporting threshold.

8. Holds, reversals and corrections

We monitor activity and keep an audit log of bookings, balances, logins, cash-outs and account changes. We may hold a credit, a cash-out or your account while we look into activity that appears unusual; withhold fees for bookings that do not qualify; reverse a cash-out that included fees you were not entitled to, or deduct those amounts from future earnings (including for chargebacks received within 120 days of a visit); and correct any error in your balance, in either direction. We will tell you why unless the law prevents us, and you can ask us to review any decision through your portal.

9. Required disclosure

US law (the Federal Trade Commission's Endorsement Guides, 16 CFR Part 255) requires that people know when a creator is paid for a recommendation. Every time you share your link, code or content about us, you must:

  1. make the disclosure clear and hard to miss, in the same place as the recommendation: say it in the video or show it on screen, and start the caption with "#ad" or "Paid partnership" (not hidden after a "more" cut or among other hashtags);
  2. use the platform's own paid-partnership or branded-content label where one exists;
  3. put the disclosure on every Story frame or slide that shows your link or code; and
  4. not rely on a discount code, "thanks to Ragescape" or "#sp" alone as the disclosure.

We may ask you to fix or remove any post that does not meet this section, and may withhold fees for bookings that came from it.

10. Your content and honest opinions

  1. You decide what, when and how you post. We never pay more or less because of what you say about us, and we will never ask you to say anything you do not believe.
  2. Claims about your own experience must come from a real visit. Do not describe experiences you did not have, and do not present stock photos or other people's footage as your own visit.
  3. Because we pay you, do not post ratings or reviews of Ragescape or Chopscape on Google, Yelp, Tripadvisor or other review sites while you are a partner; those sites do not allow reviews from people with a financial connection to the business. Never post fake or misleading reviews anywhere (the FTC's rule on consumer reviews and testimonials, 16 CFR Part 465, prohibits them). This does not limit anything you say in your own content, good or bad, and you never need to remove a review you posted before joining.
  4. Do not buy followers, views or engagement, or use bots to inflate them.
  5. Nothing in these Terms stops you from giving an honest opinion, including a critical one.

11. Promotion rules

You must not:

  • book with your own code, or ask family or friends to book with it so that you earn a fee;
  • list your code on coupon, cashback, deal or discount-listing sites or browser extensions, or let it be added to them;
  • bid on "Ragescape", "Chopscape" or similar terms (including misspellings) in paid search, or run paid ads that use our names or logos, unless we agree in writing (boosting your own organic posts on your own accounts is allowed);
  • send spam, unsolicited direct messages in bulk, or messages to people who have not agreed to hear from you;
  • offer followers your own payment, rebate or giveaway tied to using your code without our written agreement;
  • make promises about our prices, safety, availability or policies other than what we publish, or say the discount is limited-time or scarce when it is not;
  • present yourself as our employee or representative, or accept bookings or payments for us;
  • direct content about us at children under 13, or feature a minor unless you are their parent or guardian or have their guardian's written permission (if a minor appears in content you are paid for, you are responsible for any legal duties that apply to working with minors); or
  • open more than one account, share your account, or break any law, including advertising, consumer protection and privacy laws.

12. Safety and accuracy

  1. Follow our staff's instructions and our waiver whenever you visit. Keep safety gear on in every shot inside the rage rooms, the paint room and on the axe lanes.
  2. Do not show or encourage unsafe behaviour, such as smashing or throwing outside the rooms and lanes, removing gear, or bringing items we do not allow.
  3. Only show and describe what we actually offer. In the rage rooms, guests smash glass, ceramics, pottery and wood furniture. We do not offer car smashing, and you must never show, describe or suggest car smashing in connection with us.
  4. Do not post content about us that is hateful, harassing, sexually explicit, violent toward people or animals, or that promotes illegal drugs. We may pause your codes if your channel publishes content like this.

13. Your creator page

You may set up a public page for each code (at an address like ragescaperooms.com/c/yourcode/) with your display name, photo or logo, bio, headline, "my pick" note, a link to one of your posts, social handles and layout choices. By submitting them you confirm they are yours or that you have permission to use them, that they are accurate and not misleading, offensive or infringing, and you give us a non-exclusive, royalty-free permission to display them on your page, your printed materials and Program pages while you take part. We review names, photos, words and links before they go live and may decline or remove any of them. Anything you remove comes down straight away. Your page always shows that you are a paid partner. We stop displaying your page when your participation ends.

14. Using each other's names and content

  1. Our names. While you are in good standing you may use the names Ragescape and Chopscape, our logos and the graphics from your portal only to promote us through the Program. You may not create your own versions of our logos, or register domains, handles or ads using our names.
  2. Your content. You own your posts. You give us a non-exclusive, royalty-free permission, for 24 months after you post it, to repost or share content you publish about us on our own organic social accounts and website, with credit to you, and to show your name and likeness as part of that content. We will not use your content, name or likeness in paid advertising without your separate written agreement. You can ask us to stop using a piece of content at any time and we will stop within a reasonable time.

15. Content visits

You may request a hosted content visit in your portal. Each visit is confirmed individually and in writing (email is fine). Any free admission we provide for a visit is not payment for a post and does not require you to post, but if you do post about a hosted visit you must disclose it as described in section 9. Everyone in your party signs our waiver.

16. Follower privacy and your data

  1. We never share followers' names, contact details or payment information with you. Your portal shows anonymous visit counts, the platform a visit came from, and for each credited booking the date, venue, attraction, status and your fee.
  2. You must not try to identify followers from Program data or ask them to prove they used your code.
  3. How we handle your own information is explained in our Creator Privacy Notice, which forms part of these Terms.

17. Our relationship

You take part as an independent contractor. Nothing in these Terms creates an employment, partnership, joint venture or agency relationship. You decide how and whether to create and share content, you use your own equipment and pay your own costs, and you have no authority to bind us. You are free to work with other brands, including other entertainment venues.

18. Term, changes and ending the agreement

  1. Term. These Terms start when we approve your account and continue for 12 months, then renew automatically for 12 months at a time until ended as below.
  2. Changes. We may change the Program, the fees, the tiers, the follower offer or these Terms. We will give at least 30 days' notice of any change that reduces your fees, by email and in your portal. Changes never affect fees already locked on bookings made before the change takes effect. If you do not agree to a change you may close your account; continuing after the effective date means you accept it.
  3. Ending by you. You may close your account at any time from your portal.
  4. Ending by us. We may end your participation for any reason with 15 days' notice, or immediately if you breach these Terms, act fraudulently, or publish content that seriously harms our reputation.
  5. After it ends. Qualified bookings made before the end date are still paid if the visit happens within 90 days, except where your participation ended because of fraud or a serious breach, in which case we may withhold fees connected with that conduct. Sections 7, 8, 10, 14 and 16 to 21 continue to apply.

19. Disclaimers and liability

  1. We do not promise any level of visits, bookings or earnings; the calculator on our website is an illustration only. The Program, the portal and the materials are provided "as is" and "as available".
  2. To the extent the law allows, neither company is liable for indirect, incidental, special or consequential losses, or for lost profits, arising from the Program, and each company's total liability to you for all claims relating to the Program is limited to the fees that company paid or owed you in the 12 months before the claim arose.
  3. You agree to indemnify us against third-party claims, fines and reasonable costs caused by your content, your breach of these Terms or a platform's rules, or your violation of law, including disclosure and advertising laws.
  4. Nothing in these Terms limits liability that cannot be limited under applicable law.

20. Disputes and governing law

If you have a concern, please open a support request first. If we cannot resolve it informally within 30 days, either party may bring a claim in small claims court if it qualifies, or otherwise in the state or federal courts located in San Diego County, California. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

21. General terms and contact

These Terms, the Creator Privacy Notice and any rules shown in your portal are the entire agreement about the Program. If any part is found unenforceable, the rest remains in effect. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your account or these Terms. We may transfer our rights and obligations to an affiliated company or to a successor that takes over the Program, including a wider local marketplace that the Program becomes part of, and will tell you if we do. Notices to you go to the email on your account.
